Who may enjoy on-line notary services?

Any citizen of Georgia or persons having temporary residence certificate of Georgia may enjoy on-line notary services.

What is required for on-line notarization of a Statement or Consent? 

For on-line notarization of a statement or consent a computer, internet, web-camera, earphone and microphone are required.

On-line certification of notary act via skype is made by any notary practicing within the territory of Georgia.

How can one find a notary’s skype address?

Who must attend the process of on-line certification of notary act?

The process of on-line certification of a statement or consent must be attended by two persons: one of them to sign the notary act in the place of declarant and he (she) must not be the participant of notary act, or declarant’s family member, but may be the relative of the latter. The second person shall attend the process of notary act by the status of witness. He (she) shall not be declarant’s family member, relative or participant of notary deed.

Any citizen of Georgia or persons having temporary residence certificate of Georgia may enjoy on-line notary services;

How can we certify an agreement on-line? 

On-line certification of an agreement is possible only within the territory of Georgia, by participation of two or more notaries.

For on-line execution of an agreement participants shall apply to the notaries to the bureaus being convenient for them.

Notaries will connect each other on-line in the presence of the participants of the agreement. Two or more notary acts will be drawn up (as many as many notaries participate in the process of certification). Each notary act shall be signed by the person applying to notary.

 

Notary Mediation

What is notary mediation?

Notary mediation is an alternative and simplified form of dispute resolution. Dispute is resolved without considering in a court, only by notary’s assistance.

Notaries have been assigned mediator’s functions on the civil disputes on inheritance, family, neighborhood, also other property or non-property disputes.

Disputing parties start negotiations in the presence of notary and achieve agreement with its assistance.

Mediation process may be conducted within as well as outside the notary office.

 

Advantages of notary mediation.

Solving disputes simply and cheaply – disputing parties shall have no more apply to the court, just go to any mediator notary and pay less.

Volunteer and not compulsory process –for solving the dispute the conflicting parties apply to notary at their own will;

Equality – mediator notary, as an impartial advisor, equally protects the interests of each disputing party and assists them to reach an agreement;

Confidentiality – notary has no right to reveal information becoming known to it in the mediation process;

By ending of  mediation the conflict is also ended – notary mediation is not only the guarantee of agreement, but also of reconciliation;

Act of agreement – a document of indisputable evidence – following the resolution of dispute the notary draws up an act of agreement and attests it in notary order. Duties and obligations of each party are defined by the said document.
 

Facilitation of justice – courts will be unloaded from considering the civil disputes.

 

Certified Notaries perform Notary Mediation.

Duties for notary service

Amount, rule of payment and period of service for notary acts are determined under the Decree №507 of the Government of Georgia,, about approving the duty for performing notary acts and amount, rule of payment and period of service established for the Notary Chamber of Georgia” , dated December 29, 2011.

Rule of payment of duty for other notary acts are determined under the said Decree.


Amount of duty

  • For certifying of bargains for validity of which adherence to notary form is necessary under the law, duty may be established only on the basis of the rule foreseen by the above Decree.

  • For certifying of bargains for the validity of which adherence to notary form is not necessary under the law, also for other notary services, amount of duty may be established on the basis of this rule or by the agreement concluded between the notary and person interested.

  • Amount of duty is established considering the value of the subject of bargain (thing or right) or by the rates fixed regardless of the value of bargain.

  • At establishing the duty, namely at establishing minimal and maximal limits, difficulty of notary act, legal consultations being rendered, technical work performed and time spent shall be considered. 

Rule of payment 

The following services are subject to payment:

  • Fulfillment of notary act;

  • Drawing up the draft of the document;

  • Issuing photo copies of documents and fulfillment of technical service;

  • Rendering of legal consultation.

Duty shall be paid immediately at rendering the corresponding service.

At the request of the party, the notary shall submit the account showing in detail the value of rendered notary services and amount paid by the party.


Rule of appeal

Decree of the Government of Georgia, about approving the duty for performing notary acts and amount, rule of payment and period of service established for the Notary Chamber of Georgia” shall be displayed in all notary offices on the easily visible place.

If duty paid for fulfillment of notary act or other services is incorrect, one may apply to the court under the rule established by legislation.
